5. PAYMENTS & NO REFUND POLICY

ALL PAYMENTS ARE FINAL AND MADE FOR EVALUATION OR PROGRAM ACCESS PURPOSES ONLY.

Because digital access to the Services is provided immediately after purchase, no refunds are granted, except where required by applicable law.

Any payment dispute or chargeback may result in immediate suspension or termination of all related accounts and future access to OPF Capital services.

6. PROGRAM RULES & TRADING CONDITIONS (BINDING)

By purchasing and using any OPF Capital account, you agree to comply with all Trading Rules published by OPF Capital, including but not limited to:

• Daily Drawdown and Maximum Drawdown limits
• Trailing or Static Drawdown mechanisms
• Profit targets and challenge phases
• Consistency rules
• Minimum trading days and minimum profit per valid trading day
• Weekend holding restrictions
• News trading restrictions
• Leverage limits
• Add-ons and their specific conditions

Failure to comply with any rule will result in account breach, termination, or account being marked as failed, without refund.

7. NEWS TRADING RESTRICTIONS

When news trading is restricted on Funded accounts, trading activity is strictly prohibited within 5 minutes before and 5 minutes after a high-impact economic news release, or during the release, on the affected currency.

The following actions are prohibited during the restricted window:

• Opening or closing trades manually
• Modifying Stop Loss (SL) or Take Profit (TP)
• Placing, editing, or canceling pending orders

Any violation may result in immediate account termination.

8. PROHIBITED TRADING PRACTICES

The following practices are strictly prohibited and may result in account termination, profit removal, payout denial, or restriction:

• Latency arbitrage or execution abuse
• Server spamming or toxic trading flow
• Tick scalping intended to exploit execution
• Hedging or reverse trading across multiple firms
• High-frequency abusive behavior
• Fraud, identity misuse, or false documentation
• Copy trading or third-party account management without written authorization
• Any attempt to manipulate evaluation rules or bypass risk limits

OPF Capital reserves the right to determine, at its sole discretion, whether a trading strategy or behavior is abusive or inconsistent with realistic trading practices.

9. ACCOUNT INACTIVITY

Accounts may not remain inactive for more than 30 consecutive calendar days (no executed trades).
Inactive accounts may be closed without notice.

10. KYC & VERIFICATION

OPF Capital may require identity verification (KYC) and compliance checks at any time, including prior to payout processing.

Failure to provide accurate or complete information may result in account restriction, termination, or payout denial.

11. PAYOUTS & PROFIT SPLIT

Payout frequency, eligibility conditions, and profit split percentages are defined in the Trading Rules applicable to each program.

OPF Capital reserves the right to delay payouts if additional verification or compliance review is required.

12. THIRD-PARTY PROVIDERS

OPF Capital may integrate third-party services including trading platforms, analytics tools, payment processors, and verification providers.

We are not responsible for downtime, errors, delays, or restrictions caused by third-party providers.

If a third-party provider restricts or blocks a user for compliance reasons, OPF Capital may mirror such restrictions.

13. DISCLAIMER OF WARRANTIES

The Services are provided on an “as is” and “as available” basis.

OPF Capital does not guarantee uninterrupted service, error-free operation, or profitability.

Use of the Services is entirely at your own risk.

14. LIMITATION OF LIABILITY

To the maximum extent permitted by law, OPF Capital shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, loss of data, or business interruption.

Total liability shall not exceed the amount paid by the user for the relevant product or service.

15. INDEMNIFICATION

You agree to indemnify and hold harmless OPF Capital from any claim, demand, or damage arising out of:
